Terms and Conditions
By accessing, using and placing an online order through the Amy Mercer Photography site, you are indicating your acceptance to be bound by the following Terms & Conditions. This is a legal agreement between you and Amy Mercer Photography and can only be amended with the photographer’s consent. This should be read in conjunction with any details provided on this website about how it operates.
Amy Mercer Photography reserves the right to change these Terms & Conditions on this site from time to time without prior notice.
Order Timing
Once your order has been placed, I will process your details and place an order with Shire Arthouse. All prints and frames are custom made to your order. As all orders are produced upon request the typical wait time for an unframed print is five working days plus delivery, and ten working days plus delivery for a framed print, canvas floating frame and acrylic wall mount. If there are any unexpected delays Amy Mercer Photography will send you an e-mail message to notify you. For more information, please see the Shipping page.
Delivery
Finished orders are sent via Australia Post, Couriers or personally delivered by Amy Mercer Photography herself. Your order can also be tracked in which you will be sent tracking details once your order is dispatched. Please ensure you enter the correct delivery address as goods which are returned as undeliverable will incur a re-dispatch fee. Freight charges paid for the original dispatch are not refundable.
You acknowledge and agree that Amy Mercer Photography is not liable for any loss, damage, cost or expense that you incur as a result of postage.
Pricing
All prices on the Amy Mercer Photography website are displayed in Australian dollars ($AUD). Prices, specifications, availability and terms of offers may change without notice. All prices are entered manually as accurately as possible however despite best efforts and proofreading, it is subject to human error and may contain some discrepancies. Correct pricing is validated and confirmed at the time your order is placed and processed.
Artwork Colouring
Amy Mercer Photography endeavours to ensure that the colours in the photograph are represented as accurately as possible in the print however does not guarantee an exact match in colour or texture due to variations among devices used, phone and computer settings. While there are quality control processes in place, you acknowledge and agree that there are acceptable levels of colour variation.
Cropping/Stretching of the Image
There may be cases with some images on the Amy Mercer Photography website that will be subjected to cropping or stretching in order to fit within your desired dimensions.
Changes of Mind/Returns/Refunds
The utmost care is taken with all orders and each is dealt with on a case by case basis. Due to all products being custom made to order, all purchases are non-refundable in the case of the customer changing their mind. Unless there are reasons that are exceptional, once an order has been accepted and lodged with Shire Arthouse, cancellations will incur a fee of up to 100% of payments made. It is strongly advised that you review your order including all specifications before purchasing.
Amy Mercer Photography must be immediately notified if you are in any way not satisfied with your order or if there are any missing or incorrect products delivered. Please email amymercerphotos@gmail.com as soon as possible.
Damaged goods
Amy Mercer Photography strives to make every effort that your artwork arrives at your chosen address in prime condition. Framed prints are placed into custom packaging to ensure the protection of your artwork in transit. In the unlikely event that your order has arrived faulty or damaged, please contact us with your order number, name and contact number plus photographs of any damages (all external damage to the package and damages sustained to the product) to amymercerphotos@gmail.com. Amy Mercer Photography will evaluate and conduct the returns process after taking appropriate measures to minimise any potential damaging risks in delivery being repeated.
Copyright
All images displayed are subject to copyright as owned by Amy Mercer Photography. Use of these images for any purpose including images being downloaded, reproduced, copied, projected, or used in any way without the prior permission of Amy Mercer Photography is a breach of law and may result in legal action.
Digital Images supplied to the customer can be used on the basis that they are licensed to the commissioning customer only – for a time period as stated in the contract given upon purchase. Copyright remains with Amy Mercer Photography. The images provided are protected by copyright and may not be used or passed on to a third party without written permission from the photographer. Illegal copying is a breach of copyright.
Digital images will be licensed for use without a time restriction for the client’s personal use i.e to be printed overseas and framed. Should images be licensed for use for a specified period, the client will be notified in writing in the proposal. When the License to Use has expired, the images should be returned to the Photographer and a written undertaking given that all digital files have been destroyed. The customer is expected to comply with this requirement within 30 days of expiration of the License to Use. Amy Mercer Photography reserves the right to make an additional charge for continued use after this period.
Amy Mercer asserts both her moral right to be identified as the author of her work and the right to a credit is asserted in accordance with Copyright Law in Australia.
Unless otherwise agreed in writing if any picture reproduced by the Client omits the copyright notice or credit line specified by Amy Mercer Photography any fee payable by the Client shall be subject to an increase specified by Amy Mercer Photography, and in any event an increase of not less than 25%.
Privacy Policy
This policy covers how Amy Mercer Photography uses your personal information.Amy Mercer Photography takes your privacy seriously and will take all measures to protect your personal information. Amy Mercer Photography treats all your personal information as confidential and will only be used to fill your order. At no time will Amy Mercer Photography share any of your information with any other parties. Amy Mercer Photography only retains customer contact information in the form of accounts and an emailing list in order to provide further communication with past customers and inform them of any new promotions, blogs etc. You can deny to be on this emailing list by contacting Amy Mercer Photography to ‘unsubscribe’. Amy Mercer Photography will never pass on your email address to a third party for marketing purposes or store your credit card details in any database or server as all payments are processed via Shopify, PayPal, AfterPay or other payment gateways. Shopify provides a secure shopping cart solution and keeps order details secure which is Level 1 PCI compliant and uses 256-bit SSL Certificates.
